These Terms of Use (“TOU”) constitute a legally binding agreement between the user (“User”) and Virtaent (“Company”), as provided under the relevant laws, including but not limited to the Indian Contract Act, 1872, Information Technology Act, 2000, and the Information Technology rules. By accessing or using any services provided by Virtaent, the User agrees to be bound by these terms.
1. User Responsibilities:
1.1. The User agrees not to publish, host, display, upload, modify, transmit, post, communicate, update, or share any information that:
– Belongs to another person without proper authorization.
– Is harmful, harassing, abusive, defamatory, obscene, pornographic, or otherwise unlawful.
– Infringes any intellectual property rights or violates any law.
– Deceives, misleads, or impersonates another person.
– Contains viruses, malware, or any other harmful code.
– Threatens national security, public order, or sovereignty.
– Violates privacy rights or promotes enmity between groups.
2. Terms for End Customers:
2.1. By continuing to use the services provided by Virtaent, the End Customer acknowledges and agrees to these TOU and the Privacy Policy.
2.2. The End Customer acknowledges that any representations or warranties regarding products are made by the Advisor, and Virtaent shall not be liable for the Advisor’s actions.
2.3. The End Customer shall educate themselves about product plans and benefits and shall not hold Virtaent liable for any losses incurred.
2.4. The End Customer agrees not to share OTP with third parties and understands the purpose of providing personal information.
2.5. The End Customer shall evaluate the accuracy and usefulness of advice or information obtained from the Application.
3. Terms for Advisors:
3.1. Advisors shall make true and correct representations to End Customers.
3.2. Advisors shall not make false disclosures about products or solicit investments through coercion.
3.3. Advisors acknowledge that they are responsible for understanding product plans and benefits.
4. General Terms:
4.1. Users agree not to use any unauthorized mechanisms to access the Application.
4.2. Virtaent reserves the right to disable or restrict User access in case of non-compliance with these terms.
4.3. Virtaent shall not be liable for any losses or damages resulting from User actions or disclosures made in accordance with the law.
4.4. The Company’s liability is limited to Rs.1,000, and it shall not be liable for indirect or consequential damages.
4.5. Virtaent shall not be responsible for Advisor unavailability or failure to provide accurate information.
4.6. Users agree to resolve disputes through arbitration and submit to the jurisdiction of courts in Bangalore.
4.7. These TOU and Privacy Policy may be amended by Virtaent, and Users will be notified accordingly.
4.8. If any provision of these terms is deemed invalid, the remainder shall remain in force.
4.9. Virtaent shall not be liable for failure to perform obligations due to reasons beyond its control or force majeure events.
4.10. Users are responsible for ensuring compliance with applicable laws and indemnifying Virtaent against any claims arising from their actions.
By accessing or using Virtaent’s services, the User agrees to abide by these terms and conditions.
